Terms of Service
Effective [Effective date]
These terms are an agreement between you and [Operator / company name] (“we”, “us”) for your use of Rynlo: the iPhone app, the website, and live tracking pages (the “Service”). By creating an account, recording an activity, or sending a message, you agree to these terms and to our Privacy Policy.
1. Who can use Rynlo
You must be at least 16 years old and able to agree to these terms. If you use Rynlo for an organisation, you confirm you're authorised to accept these terms for it.
2. Your account
Give accurate details and keep your password secure. You're responsible for everything that happens under your account. Tell us straight away at [privacy@yourdomain.com] if you think someone else has accessed it.
3. Sharing your location
- Each activity has a share link. Anyone who has the link can see your live location, route, stats and messages, even without an account, and can pass the link on. You decide who gets it.
- The link keeps working after the activity ends until the activity is deleted. Activities are deleted automatically 7 days after they end unless you keep them, and you can delete one sooner at any time. Voice messages are deleted after 7 days.
- Think about your safety before sharing, for example whether to share routes that start or end at your home.
4. Not a safety or emergency service
Rynlo is not an emergency or safety device. Don't rely on it to get help. Location updates can be delayed, inaccurate or stop entirely because of GPS, network, battery or service problems, and messages may arrive late or not at all. In an emergency, contact your local emergency services directly.
Messages play through your headphones and can lower your music. Stay aware of your surroundings, follow road rules, and use the volume and headphone settings that keep you safe. Stats such as distance, pace and elevation are estimates.
5. Messages and content
“Content” means the text, voice recordings, names, titles and activity data you submit. You keep ownership of your content. You give us a worldwide, non-exclusive, royalty-free licence to store, process, transmit and display it only as needed to run and improve the Service: for example, to show your activity to people with your link and to play messages to the athlete. This licence ends when you delete the content, except for copies kept briefly in backups.
If you send a message, you confirm you have the right to send it and that it follows these terms. Messages, including voice notes and your sender name, are visible to the athlete and to anyone with the activity's link.
6. Acceptable use
You agree not to:
- harass, threaten, bully or intimidate anyone, or send hateful, sexually explicit or illegal content;
- pretend to be another person, or use someone else's name to mislead the athlete;
- track, stalk or share the location of anyone without their consent;
- flood athletes with messages, send spam, or get around rate limits (each athlete receives a limited number of messages per minute, and only a few play back to back);
- access other people's data or accounts, probe or overload the Service, or scrape it without permission;
- reverse engineer the Service except where the law allows it; or
- use the Service to break any law.
We may remove content or suspend accounts that break these rules. Athletes can require viewers to sign in before messaging, and can delete any activity at any time.
7. Third-party services
Maps are provided by Apple Maps (MapKit) and are subject to Apple's terms. We aren't responsible for third-party services.
8. Changes and availability
We may change, pause or stop parts of the Service. We'll try to give reasonable notice of major changes, and if we shut Rynlo down we'll give account holders time to export their data.
9. Ending your use
You can stop using Rynlo at any time and delete your account from Account on the website or Settings in the app. We may suspend or end your access if you seriously or repeatedly break these terms, or if the law requires it. Sections 5 (for content already shared), 10, 11 and 13 continue to apply after your access ends.
10. Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we don't promise that it will be uninterrupted, error-free, accurate or secure, or that messages or location updates will be delivered. Nothing in these terms limits rights you have under consumer protection laws that can't be excluded, such as the New Zealand Consumer Guarantees Act 1993 where it applies.
11. Limitation of liability
To the extent the law allows, we aren't liable for indirect, incidental, special or consequential loss, lost profits or lost data, or for loss caused by inaccurate, delayed or missing location updates or messages. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or NZD 100. Nothing here limits liability for death or personal injury caused by our negligence, or for fraud.
12. Changes to these terms
We may update these terms. If a change is material, we'll update the effective date and notify account holders before it takes effect. If you keep using Rynlo after that, you accept the new terms.
13. Governing law
These terms are governed by the laws of [New Zealand], and disputes will be heard in its courts, unless the law of the place where you live gives you the right to bring a claim there.
